These terms and conditions apply to all contracts between LiZa Memories Photography, Emina Huremović, and her clients regarding photographic services.
A contract is formed once the client submits an inquiry and LiZa Memories Photography expressly confirms the appointment or order. The individual offer agreed with the client, or the services and prices published on the website, shall apply.
The scope of services depends on the package booked or the offer agreed individually. The photographic and artistic approach, image selection and editing are carried out in the style of LiZa Memories Photography. Unedited raw files are generally not provided unless this has been expressly agreed or is included in the booked package.
The prices agreed at the time of booking shall apply. All prices are exempt from VAT pursuant to § 6 para. 1 no. 27 Austrian VAT Act (small business regulation). Payment is made either in cash directly after the session or by bank transfer once the invoice has been issued. Invoices may be sent electronically by email. Final editing and delivery of the images generally take place only after full payment has been received. Additional edited images can be purchased at the current rates.
Agreed appointments are binding. If a session has to be rescheduled for an important reason, both sides will try to find a replacement date. If the client cancels less than 48 hours before the agreed appointment, a cancellation fee of 50% of the agreed amount may be charged. In the event of non-attendance without cancellation, the full fee may be charged. In cases of illness, force majeure or weather-related impossibility, a replacement date will be arranged wherever possible.
Sessions usually take place in Graz or at the location agreed individually. Travel costs outside Graz are agreed separately or charged according to actual expense.
Images are delivered digitally via an online gallery or download link. Editing usually takes up to 72 hours and no more than 7 days after payment has been received, unless agreed otherwise. For weddings, special offers or larger projects, delivery times may differ.
Copyright for all images remains with LiZa Memories Photography. The client receives a simple, non-transferable right of use for private purposes. Commercial use, transfer to third parties, publication in media, participation in competitions or substantial subsequent editing of the images require prior written consent.
LiZa Memories Photography may only use images for the website, social media, portfolio or promotional purposes with the client’s express consent.
LiZa Memories Photography shall only be liable for damages caused intentionally or by gross negligence to the extent permitted by law. In the event of technically caused data loss, failure due to force majeure or unforeseeable circumstances, liability is limited to refunding payments already made or, at the discretion of LiZa Memories Photography, arranging a replacement appointment.
Austrian law shall apply. Mandatory consumer rights remain unaffected. Should any provision of these terms and conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
